United States Vape Laws

Welcome to out detailed guide on United States Vape Laws. In the United States, vaping (AKA e-cigarettes, vapes, nicotine e-liquid, and vaping) is primarily determined on a state by state basis.  Below we will break down any state regulation or laws regarding vaping regulations.


FEDERAL VAPING LAWS:

At this time there are no official Federal vaping laws in place in the United States.  Current President Donald Trump has made mention of vaping and potential new Federal laws to ban flavoured vaping products across the U.S. but no official legislation has been enacted at this time.  At this time it is a wait and see as far as any Federal regulations specific to vaping or e-cigarette use in the United States.


STATE-BY-STATE VAPING LAWS:

   Alabama Vaping Laws

The state of Alabama has defined e-cigarettes in their State laws. They have not included vaping or e-cigarettes in their definition of a tobacco product.  They currently have no special or excise tax on vaping products (e-cigarettes) in place.  Alabama has current laws restricting youth access.  Alabama’s legal minimum age to purchase vaping products is 19+.  Alabama has regulations on e-cigarette packaging effective August 1, 2019.  Alabama requires retail licenses to sell vaping products, also effective August 1, 2019.

 Alaska Vaping Laws

The state of Alaska has defined e-cigarettes in their State laws. They have not included vaping or e-cigarettes in their definition of a tobacco product.  They currently have no special or excise tax on vaping products (e-cigarettes) in place.  Alaska has current laws restricting youth access.  Alaska’s legal minimum age to purchase vaping products is 19+.  Alaska has no regulations on e-cigarette packaging.  Alaska requires retail licenses to sell vaping products, also effective January 1, 2019.

 Arizona Vaping Laws

The state of Arizona has defined e-cigarettes in their State laws. They have not included vaping or e-cigarettes in their definition of a tobacco product.  They currently have no special or excise tax on vaping products (e-cigarettes) in place.  Arizona has current laws restricting youth access.  The legal minimum age to purchase vaping products in Arizona is 18+.  Arizona has no regulations on e-cigarette packaging.  Arizona has no requirements for retail store licenses to sell e-cigarettes and vaping products.

 Arkansas Vaping Laws

The state of Arkansas has has defined e-cigarettes in their State laws. They have not included vaping or e-cigarettes in their definition of a tobacco product.  They currently have no special or excise tax on vaping products (e-cigarettes) in place.  Arkansas has current laws restricting youth access.  The legal minimum age to purchase vaping products in Arkansas is 21+.  Arkansas has regulations on e-cigarette packaging that went into affect on July 22, 2015.  Arkansas requires retail licenses to sell vaping products, which is effective May 1, 2015.

 California Vaping Laws

The state of California has defined e-cigarettes  in their State laws.  They have also included vaping and e-cigarettes in their definition of tobacco products.  California currently has a special tax for vaping products (e-cigarettes) in place, effective April 1st, 2017.  California has current laws restricting youth access.  The legal minimum age to purchase vaping products in California is 21+.  They have regulations on e-cigarette packaging that went into affect on June 9, 2016.  California requires retail licenses to sell vaping products, which is effective January 1, 2017.

CALIFORNIA VAPING UPDATE:   On September 16th, Gov. Gavin Newsom issued an executive order to allocate $20 million dollars for a “vaping awareness campaign”, as well as calling on state agencies to develop recommendations for limiting vaping products to those who are 21 and older.  as well as reducing the sales of illegal and counterfeit vaping products.  It further requests the California Department of Public Health to require retail stores selling vaping products to post warning signs about the health risks of vaping (SOURCE).

SAN FRANCISCO VAPING BAN UPDATE: San Francisco has banned the sale of all nicotine e-cigarette products in their city (SOURCE).

LOS ANGELES VAPING BAN UPDATE: The Los Angeles County Board of Supervisors is moving toward a ban of flavoured vaping products (SOURCE).

 Colorado Vaping Laws

The state of Colorado has defined e-cigarettes  in their State laws.  They have also included vaping and e-cigarettes in their definition of tobacco products.  Colorado currently has no special taxes for vaping products (e-cigarettes).  Colorado has current laws restricting youth access.  The legal minimum age to purchase vaping products in Colorado is 18+.  Colorado has no regulations on e-cigarette packaging.  Colorado does not require retail licenses to sell vaping products.

 Connecticut Vaping Laws

The state of Connecticut has defined e-cigarettes  in their State laws.  They have also included vaping and e-cigarettes in their definition of tobacco products.  Connecticut currently has special taxes for vaping products (e-cigarettes) that went into place on October 1st, 2019.  Connecticut has current laws restricting youth access.  The legal minimum age to purchase vaping products in Connecticut is 21+.  Connecticut has no regulations on e-cigarette packaging.  Connecticut requires retail licenses to sell vaping products, which is effective as of March 1st, 2016.

 Delaware Vaping Laws

The state of Delaware has defined e-cigarettes  in their State laws.  They have also included vaping and e-cigarettes in their definition of tobacco products.  Delaware currently has special taxes for vaping products (e-cigarettes) that went into place on January 1st, 2018.  Delaware has current laws restricting youth access.  The legal minimum age to purchase vaping products in Delaware is 21+.  Delaware has no regulations on e-cigarette packaging.  Delaware has no requirement for retail licenses to sell vaping products, with the exception of e-liquids, which requires a license.

 Florida Vaping Laws

The state of Florida has defined e-cigarettes  in their State laws.  They have not included vaping and e-cigarettes in their definition of tobacco products.  Florida currently has no special taxes for vaping products (e-cigarettes).  Florida has current laws restricting youth access.  The legal minimum age to purchase vaping products in Florida is 18+.  Florida has no regulations on e-cigarette packaging.  Florida has no requirement for retail licenses to sell vaping products.

 Georgia Vaping Laws

The state of Georgia has defined e-cigarettes  in their State laws.  They have not included vaping and e-cigarettes in their definition of tobacco products.  Georgia currently has no special taxes for vaping products (e-cigarettes).  Georgia has current laws restricting youth access.  The legal minimum age to purchase vaping products in Georgia is 18+.  Georgia has no regulations on e-cigarette packaging.  Georgia has no requirement for retail licenses to sell vaping products.

 Hawaii Vaping Laws

The state of Hawaii has defined e-cigarettes  in their State laws.  They have included vaping and e-cigarettes in their definition of tobacco products.  Hawaii currently has no special taxes for vaping products (e-cigarettes).  Hawaii has current laws restricting youth access.  The legal minimum age to purchase vaping products in Hawaii is 21+.  Hawaii has no regulations on e-cigarette packaging.  Hawaii requires a retail licenses to sell vaping products, effective July 1, 2018.

 Idaho Vaping Laws

The state of Idaho has defined e-cigarettes  in their State laws.  They have not included vaping and e-cigarettes in their definition of tobacco products.  Idaho currently has no special taxes for vaping products (e-cigarettes).  Idaho has current laws restricting youth access.  The legal minimum age to purchase vaping products in Idaho is 18+.  Idaho has no regulations on e-cigarette packaging.  Hawaii does not require a retail licenses to sell vaping products.

 Illinois Vaping Laws

The state of Illinois has defined e-cigarettes  in their State laws.  They include vaping and e-cigarettes in their definition of tobacco products.  Illinois has special taxes for vaping products (e-cigarettes) that were enacted On July 1, 2019.  Illinois has current laws restricting youth access.  The legal minimum age to purchase vaping products in Illinois is 21+.  Illinois has regulations on e-cigarette packaging effective January 1, 2015.  Illinois does not require a retail license to sell vaping products.

 Indiana Vaping Laws

The state of Indiana has defined e-cigarettes  in their State laws.  They include vaping and e-cigarettes in their definition of tobacco products.  Illinois does not have special taxes for vaping products (e-cigarettes).  Indiana has current laws restricting youth access.  The legal minimum age to purchase vaping products in Indiana is 18+.  Indiana has regulations on e-cigarette packaging, effective July 1, 2015.  Indiana requires a retail license to sell vaping products, effective July 1, 2015.

 Iowa Vaping Laws

The state of Iowa has defined e-cigarettes  in their State laws.  They do not include vaping and e-cigarettes in their definition of tobacco products.  Iowa does not have special taxes for vaping products (e-cigarettes).  Iowa has current laws restricting youth access.  The legal minimum age to purchase vaping products in Iowa is 18+.  Iowa does not have regulations on e-cigarette packaging.  Iowa requires a retail license to sell vaping products, effective July 1, 2014.

 Kansas Vaping Laws

The state of Kansas has defined e-cigarettes  in their State laws.  They do not include vaping and e-cigarettes in their definition of tobacco products.  Kansas has special taxes for vaping products (e-cigarettes) that went into place on July 1, 2017.  Iowa has current laws restricting youth access.  The legal minimum age to purchase vaping products in Kansas is 18+.  Kansas does not have regulations on e-cigarette packaging.  Kansas requires a retail license to sell vaping products, effective July 1, 2012.

 Kentucky Vaping Laws

The state of Kentucky has defined e-cigarettes  in their State laws.  They do not include vaping and e-cigarettes in their definition of tobacco products.  Kentucky does not have special taxes for vaping products (e-cigarettes).  Kentucky has current laws restricting youth access.  The legal minimum age to purchase vaping products in Kentucky is 18+.  Kentucky does not have regulations on e-cigarette packaging.  Kansas does not require a retail license to sell vaping products.

 Louisiana Vaping Laws

The state of Louisiana has defined e-cigarettes  in their State laws.  They do not include vaping and e-cigarettes in their definition of tobacco products.  Louisiana does have special taxes for vaping products (e-cigarettes), in place since July 1, 2015.  Louisiana has current laws restricting youth access.  The legal minimum age to purchase vaping products in Louisiana is 18+.  Louisiana does not have regulations on e-cigarette packaging.  Louisiana does not require a retail license to sell vaping products.

 Maine Vaping Laws

The state of Maine has defined e-cigarettes  in their State laws.  They include vaping and e-cigarettes in their definition of tobacco products.  Maine has proposed a special tax for vaping products (e-cigarettes), that it set to come into place January 2, 2020.  Maine has current laws restricting youth access.  The legal minimum age to purchase vaping products in Maine is 21+.  Maine has regulations on e-cigarette packaging.  Maine requires a retail license to sell vaping products that went into place on November 1st, 2017.

 Maryland Vaping Laws

The state of Maryland has defined e-cigarettes  in their State laws.  They include vaping and e-cigarettes in their definition of tobacco products.  Maryland has no special taxes for vaping products (e-cigarettes).  Maryland has current laws restricting youth access.  The legal minimum age to purchase vaping products in Maryland is 21+.  Maryland has no regulations on e-cigarette packaging.  Maine requires a retail license to sell vaping products that went into place on October 1, 2017.

 Massachusetts Vaping Laws

The state of Massachusetts has defined e-cigarettes  in their State laws.  They include vaping and e-cigarettes in their definition of tobacco products.  Massachusetts has no special taxes for vaping products (e-cigarettes).  Massachusetts has current laws restricting youth access.  The legal minimum age to purchase vaping products in Massachusetts is 21+.  Maryland has regulations on e-cigarette packaging that went into place September 25, 2015.  Massachusetts does not require a retail license to sell vaping products.

MASSACHUSETTS BAN UPDATE: On Sept 24th Gov. Charlie Baker announced a four-month statewide ban on retail and online sales of all marijuana and vaping products, flavoured or otherwise.  This policy is in effect until January 25, 2020 (SOURCE).

 Michigan Vaping Laws

The state of Michigan has defined e-cigarettes  in their State laws.  They do not include vaping and e-cigarettes in their definition of tobacco products.  Michigan has no special taxes for vaping products (e-cigarettes).  Massachusetts has current laws restricting youth access.  The legal minimum age to purchase vaping products in Michigan is 18+.  Michigan has regulations on e-cigarette packaging that went into place September 2, 2019.  They do not require a retail license to sell vaping products.

MICHIGAN BAN UPDATE:  In early November Gov. Gretchen Whitmer issued an emergency ban on the online and retail sale of nicotine vaping products in any flavour except tobacco.  The ban was made official September 18th, but on October 15th a Michigan Court of Claims judge sided with retailers who claimed that Whitmer overstepped her authority.  The judges injunction lasts six months (SOURCE).

 Minnesota Vaping Laws

The state of Minnesota has defined e-cigarettes  in their State laws.  They include vaping and e-cigarettes in their definition of tobacco products.  Minnesota has special taxes for vaping products (e-cigarettes) that went into place August 1, 2010.  Minnesota has current laws restricting youth access.  The legal minimum age to purchase vaping products in Minnesota is 18+.  Minnesota has regulations on e-cigarette packaging that went into place May 21, 2014.  Minnesota requires a retail license to sell vaping products as of August 1, 2014.

Mississippi Vaping Laws

The state of Mississippi has defined e-cigarettes  in their State laws.  They do not include vaping and e-cigarettes in their definition of tobacco products.  Mississippi has no special taxes for vaping products (e-cigarettes).  Mississippi has current laws restricting youth access.  The legal minimum age to purchase vaping products in Mississippi is 18+.  Mississippi has no regulations on e-cigarette packaging.  Mississippi does not require a retail license to sell vaping products.

Missouri Vaping Laws

The state of Missouri has defined e-cigarettes  in their State laws.  They do not include vaping and e-cigarettes in their definition of tobacco products.  Missouri has no special taxes for vaping products (e-cigarettes).  Missouri has current laws restricting youth access.  The legal minimum age to purchase vaping products in Missouri is 18+.  Missouri has regulations on e-cigarette packaging effective August 28, 2015.  Mississippi requires a retail license to sell vaping products effective October 10, 2014.

Montana Vaping Laws

The state of Montana has defined e-cigarettes  in their State laws.  They do not include vaping and e-cigarettes in their definition of tobacco products.  Montana has no special taxes for vaping products (e-cigarettes).  Montana has current laws restricting youth access.  The legal minimum age to purchase vaping products in Montana is 18+.  Montana has no regulations on e-cigarette packaging.  Montana requires a retail license to sell vaping products effective January 1, 2016.

Nebraska Vaping Laws

The state of Nebraska has defined e-cigarettes  in their State laws.  They do not include vaping and e-cigarettes in their definition of tobacco products.  Nebraska has no special taxes for vaping products (e-cigarettes).  Nebraska has current laws restricting youth access.  The legal minimum age to purchase vaping products in Nebraska is 19+.  Nebraska has no regulations on e-cigarette packaging.  Nebraska currently has no requirements, but is set to require a retail license to sell vaping products that will come into place January 1st, 2020.

Nevada Vaping Laws

The state of Nevada has defined e-cigarettes  in their State laws.  They include vaping and e-cigarettes in their definition of tobacco products.  Nevada is set to have special taxes for vaping products (e-cigarettes) that will come into place January 1, 2020 .  Nevada has current laws restricting youth access.  The legal minimum age to purchase vaping products in Nevada is 18+.  Nevada has no regulations on e-cigarette packaging.  Nevada is set to require a retail license to sell vaping products that will come into place January 1st, 2020.

New Hampshire Vaping Laws

The state of New Hampshire has defined e-cigarettes  in their State laws.  They do not include vaping and e-cigarettes in their definition of tobacco products.  New Hampshire does not have special taxes for vaping products (e-cigarettes) .  New Hampshire has current laws restricting youth access.  The legal minimum age to purchase vaping products in New Hampshire is 18+.  They have regulations on e-cigarette packaging effective as of January 6, 2017.  New Hampshire does not require a retail license to sell vaping products.

New Jersey Vaping Laws

The state of New Jersey has defined e-cigarettes  in their State laws.  They include vaping and e-cigarettes in their definition of tobacco products.  New Jersey has special taxes for vaping products (e-cigarettes) effective July 1, 2019 .  New Jersey has current laws restricting youth access.  The legal minimum age to purchase vaping products in New Jersey is 21+.  New Jersey has regulations on e-cigarette packaging effective as of January 19, 2016.  They do not require a retail license to sell vaping products.

New Mexico Vaping Laws

The state of New Mexico has defined e-cigarettes  in their State laws.  They include vaping and e-cigarettes in their definition of tobacco products.  New Mexico has special taxes for vaping products (e-cigarettes) effective July 1, 2019 .  New Mexico has current laws restricting youth access.  The legal minimum age to purchase vaping products in New Mexico is 18+.  They have regulations on e-cigarette packaging effective as of April 8, 2015.  New Mexico does not require a retail license to sell vaping products.

New York Vaping Laws

The state of New York has defined e-cigarettes  in their State laws.  They do not include vaping and e-cigarettes in their definition of tobacco products.  New York is set to implement special taxes for vaping products (e-cigarettes) to be effective December 1, 2019 .  New York has current laws restricting youth access.  The legal minimum age to purchase vaping products in New York is 21+.  New York has regulations on e-cigarette packaging effective as of December 29, 2014.  They are set to implement requirements for a retail license to sell vaping products effective December 1, 2019.

NEW YORK BAN UPDATE:  On September 17th, Gov. Andrew Cuomo implicated a statewide ban on most flavored nicotine vaping products.  It restricts the sales of most flavoured vaping products, but does not restrict the sales of menthol flavored vaping products.  Menthol flavored cigarettes are currently for sale in New York State.

The ban began to be enforced on October 4th after a two week grace period expired.  Retailers currently face a fine of up to $2,000 for selling flavored vaping products.  This ban is up for renewal every 90 days (SOURCE).

North Carolina Vaping Laws

The state of North Carolina has defined e-cigarettes  in their State laws.  They include vaping and e-cigarettes in their definition of tobacco products.  North Carolina has special taxes for vaping products (e-cigarettes) as of June 1, 2015 .  North Carolina has current laws restricting youth access.  The legal minimum age to purchase vaping products in North Carolina is 18+.  North Carolina has regulations on e-cigarette packaging effective as of January  1, 2015.  They have no requirements for a retail license to sell vaping products.

North Dakota Vaping Laws

The state of North Dakota has defined e-cigarettes  in their State laws.  They do not include vaping and e-cigarettes in their definition of tobacco products.  North Dakota does not have special taxes for vaping products (e-cigarettes) .  North Dakota has current laws restricting youth access.  The legal minimum age to purchase vaping products in North Dakota is 18+.  North Dakota has regulations on e-cigarette packaging effective as of April 8, 2015.  They have no requirements for a retail license to sell vaping products.

Ohio Vaping Laws

The state of Ohio has defined e-cigarettes  in their State laws.  They include vaping and e-cigarettes in their definition of tobacco products.  Ohio is set to have special taxes for vaping products (e-cigarettes) effective October 1, 2019 .  Ohio has current laws restricting youth access.  The legal minimum age to purchase vaping products in Ohio is 21+.  Ohio has regulations on e-cigarette packaging effective as of August 2, 2014.  Ohio requires a retail license to sell vaping products, effective July 18, 2019.

Oklahoma Vaping Laws

The state of Oklahoma has defined e-cigarettes  in their State laws.  They do not include vaping and e-cigarettes in their definition of tobacco products.  Oklahoma does not have special taxes for vaping products (e-cigarettes).  Oklahoma has current laws restricting youth access.  The legal minimum age to purchase vaping products in Oklahoma is 18+.  Oklahoma does not have regulations on e-cigarette packaging.  Oklahoma does not require a retail license to sell vaping products.

Oregon Vaping Laws

The state of Oregon has defined e-cigarettes  in their State laws.  They do not include vaping and e-cigarettes in their definition of tobacco products.  Oregon does not have special taxes for vaping products (e-cigarettes).  Oregon has current laws restricting youth access.  The legal minimum age to purchase vaping products in Oregon is 21+.  Oregon has regulations on e-cigarette packaging, effective May 26, 2015.  Oregon does not require a retail license to sell vaping products.

Pennsylvania Vaping Laws

The state of Pennsylvania has defined e-cigarettes  in their State laws.  They include vaping and e-cigarettes in their definition of tobacco products.  Pennsylvania has special taxes for vaping products (e-cigarettes) effective July 13, 2016.  Pennsylvania has current laws restricting youth access.  The legal minimum age to purchase vaping products in Pennsylvania is 18+. Pennsylvania has regulations on e-cigarette packaging, effective October 1, 2016.  They require a retail license to sell vaping products, effective July 13, 2016.

PENNSYLVANIA UPDATE: September 25th, 2019, a bill was read to move the legal age for purchasing cigarettes and e-cigarettes from 18 to 21.  It was approved by a vote of 43-6.  The bill now goes to the House for consideration (SOURCE).

Rhode Island Vaping Laws

The state of Rhode Island has defined e-cigarettes  in their State laws.  They do not include vaping and e-cigarettes in their definition of tobacco products.  Rhode Island does not have special taxes for vaping products (e-cigarettes).  Rhode Island has current laws restricting youth access.  The legal minimum age to purchase vaping products in Rhode Island is 18+.  Rhode Island has regulations on e-cigarette packaging, effective January 1, 2015.  They require a retail license to sell vaping products, effective January 1, 2015.

RHODE ISLAND VAPE BAN UPDATE: Gov. Gina Raimondo signed an executive order on September 25th banning the sale of flavoured e-cigarettes in the state.  The ban could go into affect as soon as the following week.  It is unknown if this ban will effect menthol flavours, but will not extend to unflavored tobacco products.  The ban is said to be in effect for 120 days, with the state having the ability to further extend it for another 60 days.

South Carolina Vaping Laws

The state of South Carolina has defined e-cigarettes  in their State laws.  They do not include vaping and e-cigarettes in their definition of tobacco products.  South Carolina does not have special taxes for vaping products (e-cigarettes).  South Carolina has current laws restricting youth access.  The legal minimum age to purchase vaping products in South Carolina is 18+.  South Carolina has regulations on e-cigarette packaging, effective April 26, 2019.  In fact, South Carolina does not require a retail license to sell vaping products.

South Dakota Vaping Laws

The state of South Dakota has defined e-cigarettes in their State laws. They include vaping and e-cigarettes in their definition of tobacco products. South Dakota does not have special taxes for vaping products (e-cigarettes). South Dakota has current laws restricting youth access.  The legal minimum age to purchase vaping products in South Dakota is 18+. South Carolina has regulations on e-cigarette packaging, effective March 28, 2014. South Dakota does not require a retail license to sell vaping products.

Tennessee Vaping Laws

The state of Tennessee has defined e-cigarettes  in their State laws. They do not include vaping and e-cigarettes in their definition of tobacco products.  Tennessee does not have special taxes for vaping products (e-cigarettes). Tennessee has current laws restricting youth access. The legal minimum age to purchase vaping products in Tennessee is 18+. Tennessee has regulations on e-cigarette packaging, effective January 1, 2016.  Tennessee does not require a retail license to sell vaping products.

Texas Vaping Laws

The state of Texas has defined e-cigarettes  in their State laws.  They do not include vaping and e-cigarettes in their definition of tobacco products.  Texas does not have special taxes for vaping products (e-cigarettes).  Texas has current laws restricting youth access.  The legal minimum age to purchase vaping products in Texas is 21+.  Texas has regulations on e-cigarette packaging, effective January 1, 2015.  Texas requires a retail license to sell vaping products, effective October 1, 2015.

Utah Vaping Laws

The state of Utah has defined e-cigarettes  in their State laws.  They include vaping and e-cigarettes in their definition of tobacco products.  Utah does not have special taxes for vaping products (e-cigarettes).  Utah has current laws restricting youth access.  The legal minimum age to purchase vaping products in Utah is 19+.  Utah will increase the minimum age requirement to purchase e-cigarette products to 20 only July 1, 2020, and to 21 on July 1, 2021.  This state has regulations on e-cigarette packaging, effective July 1, 2015.  Utah requires a retail license to sell vaping products, effective July 1, 2015.

Vermont Vaping Laws

The state of Vermont has defined e-cigarettes  in their State laws. They include vaping and e-cigarettes in their definition of tobacco products.  Vermont has special taxes for vaping products (e-cigarettes), effective July 1, 2019.  Vermont has current laws restricting youth access.  The legal minimum age to purchase vaping products in Vermont is 21+. Vermont has regulations on e-cigarette packaging, effective January 1, 2015. Vermont requires a retail license to sell vaping products, effective July 1, 2013.

Virginia Vaping Laws

The state of Virginia has defined e-cigarettes  in their State laws.  They do not include vaping and e-cigarettes in their definition of tobacco products.  Virginia does not have special taxes for vaping products (e-cigarettes).  Virginia has current laws restricting youth access.  The legal minimum age to purchase vaping products in Virginia is 21+, which came into effect July 1, 2019.    Virginia has regulations on e-cigarette packaging, effective April 15, 2015.  Virginia does not require a retail license to sell vaping products.

Washington Vaping Laws

The state of Washington has defined e-cigarettes  in their State laws.  They do not include vaping and e-cigarettes in their definition of tobacco products.  Washington has special taxes for vaping products (e-cigarettes) effective October 1, 2019.  Washington has current laws restricting youth access.  The legal minimum age to purchase vaping products in Washington is 21+.  This state has regulations on e-cigarette packaging, effective June 28, 2016.  Washington requires a retail license to sell vaping products, effective June 28, 2016.

WASHINGTON BAN UPDATE:  On October 9th, 2019, Gov. Jay Inslee used an executive order by way of health officials to ban the sale of flavored vaping products.  This ban includes vapes containing THC.   The ban will be in effect for 120 days.  During the reading, “Shame” was being chanted by many vaper shop owners and vapers who had used the product to quit smoking cigarettes (SOURCE).

West Virginia Vaping Laws

The state of West Virginia has defined e-cigarettes  in their State laws.  They include vaping and e-cigarettes in their definition of tobacco products.  West Virginia has special taxes for vaping products (e-cigarettes) effective July 1, 2016.  West Virginia has current laws restricting youth access.  The legal minimum age to purchase vaping products in West Virginia is 18+.  West Virginia does not have regulations on e-cigarette packaging.  West Virginia does not require a retail license to sell vaping products.

Wisconsin Vaping Laws

The state of Wyoming has defined e-cigarettes  in their State laws.  They include vaping and e-cigarettes in their definition of tobacco products.  Wyoming does not have special taxes for vaping products (e-cigarettes).  Wyoming has current laws restricting youth access.  The legal minimum age to purchase vaping products in Wyoming is 18+.  Wisconsin has regulations on e-cigarette packaging, effective July 1, 2015.  Wyoming does not require a retail license to sell vaping products.


STATE  BY STATE OVERVIEW:

  • All 51 States have defined “e-cigarettes” in their State Laws.
  • 23/51 states (45%) have classified e-cigarette products together with tobacco products
  • 20/51 States (40%) have specific excise or special tax for e-cigarette products
  • 51/51 States (100%) have minimum legal sales ages.  All States legal minimum age to purchase e-cigarette products range from 18-21
  • 29/51 States have their minimum age set to 18 (57%), 4/51 minimum age of 19 (9%), and 18/51 minimum age of 21 (35%).
  • 29/51 (58%)  States have laws on Product packaging of e-cigarettes, while 42% have no lows on e-cigarette product packaging.
  • 26/51 (51%) States have laws that require licenses for retail sales of e-cigarette products.  49% have no laws.
