    Specific Prohibitions:

    • Various definitions are provided regarding where vapour products are not to be sold, including definitions for “building or structure,” “campus,” and “public body.”
    • Certain places are exempt from the prohibition, such as health care providers’ spaces, government-leased areas, and certain designated spaces within retail premises.
    • Restrictions are specified for smoking or using vapour products near doorways, windows, or air intakes, with a prescribed distance of 6 meters. However, transit shelters are exempt from this rule.
    • Patios associated with public places are exempt from smoking and vapour product restrictions under specific conditions.

    Exemptions and Accessories:

    • Exemptions exist for persons in care or residents in designated areas within care facilities, hotels, and for sampling e-substances within specific conditions.

    Administrative Penalties:

    The cannabis laws in British Columbia:

    • Age Restriction: Individuals must be 19 years or older to buy, use, possess, or grow non-medical cannabis in British Columbia (B.C.).
    • Authorized Sellers: Non-medical cannabis is sold exclusively at government-run stores, licensed private retailers, and the B.C. government’s online store. The BC Liquor Distribution Branch operates public retail stores and an online store. Licensed private retailers are monitored and licensed by the Liquor and Cannabis Regulation Branch.     The Government of Canada has required that all new E-cigarette devices & accessories are to be CRC-compliant and CRC-certified. CRC stands for Child Resistant Containers. What does this mean to Canada Vapes consumers? In short, the government is making it so devices are child-proof to prevent our youth from getting into the tanks, pods, and glassmakers that hold or store e-liquid. This is a good thing for vaping as it reduces harm for children as consuming these can be dangerous! It may mean a little extra work for filling e-liquid but in the long run, it is an easy, common sense step forward for the CRC compliance in the Canadian vaping industry.

    CRC Certified would be devices that are filled by the person using it, devices like:

    • Tanks
    • Coils & Atomizers
    • Cartridges & Pods
    • Open Pod Systems

     

    CRC Compliant devices would include, devices that are disposable and the consumer would not fill, such as:

    • Disposable Vaping Devices

    What does this mean for you?
    This may affect you if you were to purchase a kit or accessory that you have in the past.     Health Minister Adrian Dix is planning to introduce new legislation this month that will increase the British Columbia sales tax from 7% to 20% on vaping products.

    If passed, this new tax rate will start January 1, 2020. According to estimates, this tax will generate approximately $10 million a year to the provincial government.

    The justification for this tax is as follows: “We know that youth are particularly price-sensitive, so when you make a product more expensive and harder to access, users will decline.”

    In addition to the vaping tax, the government of British Columbia is proposing a 20 mg/ml cap for e-liquid sold in the province. At this time the only legal restriction on nicotine strength in e-liquid is 66 mg/ml. The European Union has a similar 20 mg/ml of e-liquid sold in Europe.  Health professionals in Europe suggest this level encourages smoking cessation.

    Advocates of vaping, including the Vaping Industry Trade Association, believe increasing the prices of vaping products through taxes could lead customers into the black market. This would reduce the safety of vaping products in British Columbia. They state that these restrictions could “undermine the switching rates of smokers towards less harmful alternatives.”

    In British Columbia, there are an estimated 90,000 businesses currently selling vaping products. Of those, the vast majority are convenience stores and gas stations.

    Since 2015 it is been illegal to sell vaping products to anyone under the age of 19 in B.C. Legislation. This has been the only vaping restriction in British Columbia until this proposed legislation.

    There will be additional restrictions on any business selling vaping products that are not dedicated vaping stores. These restrictions would ban these locations from selling any e-liquid outside of regular tobacco flavours. Only dedicated vaping shops in British Columbia, of which there are approximately 150, would be allowed to sell all flavors of e-liquid.

    This proposed regulation will not ban any specific flavours, however, in the conversation is an increased awareness plan to educate the youth in B.C. Legislation on vaping.  Todd Stone, the opposition Liberal in BC is welcoming government legislation. He wants to see all additional taxes gained from this proposed legislation be allocated to the education of youth in British Columbia.

    There are many things I like about this proposal as a vape shop owner in Ontario. I do believe that vape products should be sold only in regulated vaping retail locations where IDs are checked at the door. In gas stations and convenience stores where youth have access to enter the premises without restriction, vaping products should simply not be sold at all.

    I do not think increasing taxes specifically on vaping products will have any net positive result in reducing youth vaping in British Columbia. Vape product costs rising from $30-$34 would have very few youths suddenly become unable to purchase the products. By reducing the areas where these vaping products can be purchased, it would be much easier to ensure that these 150 stores are correctly turning away minors, compared with policing 90,000+ gas stations and convenience stores.

    I very much support the idea of increased education for youth. This education should be allocated to all adult-centered products and services legally accessible to Canadian adults, including gambling, alcohol use, marijuana, and vaping.

    We at Canada Vapes strongly push back at the idea that any vaping products are geared toward selling to minors. It simply doesn’t make sense for any reputable vaping company to promote or advertise their products to customers who cannot legally purchase the product. We are interested only in promoting our products to adult smokers in Canada who are unable to quit smoking cigarettes and are looking for an alternative.

    Adults enjoy sweet candy flavors, in their alcoholic drinks, at the supermarket checkout, in their cereal selections, and in many other areas of life. By using this argument it will be suggested that Tim Horton’s is targeting youth when they create succulent donuts and pastries covered in chocolate, maple, and other sweet and delicious flavours. The same argument could be made against Starbucks when promoting their holiday drinks.  Adults enjoy sweet candy and dessert flavours and these flavour choices are what make vaping effective for adults transitioning away from tobacco cigarettes.

    Vancouver City proposes a motion to ban vape ads & minimum distances between vape shops and schools.

    Lisa Dominato has put forward a motion to limit the sale and promotion of vape equipment and Vape Ads within Vancouver City.

    There are currently no restrictions on the sales of vaping products and she is looking to change that.

    Counselor Rebecca Bligh wants restrictions that would limit how close vaping shops can be to schools as well as youth-oriented facilities. She is also looking to ban any advertisements on city-owned properties.

    The Health Minister of British Columbia stated on October 29 that British Columbia is planning regulatory action that would involve education, youth empowerment, and governmental pressure regarding the use of vaping in British Columbia.

    If this motion passes, Dominato is looking to have a framework available for early 2020

    Dominato stated “It feels like we are a little bit in catch-up mode” when discussing this motion.

We believe it’s equally important to ensure all retail locations of vaping products in British Columbia, as well as across Canada, are being regulated to ensure they are not selling the products to minors.     City Council voted unanimously against advertisements for vaping products on any city property throughout Richmond British Columbia.

    Clay Adams, who is the spokesperson for the city of Richmond, states “vaping is a significant health issue. All the evidence suggests that, and this is the at least one thing that we can do. We hope others will follow suit and do similar.”

    I disagree with this concept that promoting any adult recreational activities or harm reducing activities should be banned across Canada. If this is going to the stance of our government, we should be banning all alcohol and gambling related advertisements in any public places. These activities both have the potential to do great harm to the youth in our Country.

    What I’d rather see, is to require any vaping advertisements to come with it additional risks and information similar to the responsible gambling rules required for promotion of gambling. To my understanding, there are no required warnings on alcohol advertisements in Canada.

    Almost everything we do carries with it a degree of risk. Unless we want to see Canada become either a nanny state, or worse some sort of socialist – communist society, there needs to be some sort of free market capabilities and grace for various products and services that are for adults.

    The typical responses that have been touted around by our government continues with this legislation.  “We don’t know what is in them, therefore let’s ban them” and “they may be a gateway for our youth to start smoking”.  Both of these statements have been proven false again and again, yet our government uses them as a method to control a life saving device.

    In our review of vaping and adolescent studies by the CDC, the amount of tobacco use in young people has gone down nearly 100% over the past 5 years, since the growth of vaping and e-cigarettes.  This should be seen as a great thing and is happening despite of the ignorance of our government and not due to their promotion or acceptance of vaping and e-cigarettes.

    B.C. to restrict use and sale of e-cigarettes and vapes

    VICTORIA – B.C. is banning the sale of electronic cigarettes to minors and forbidding their use in buildings across the province, similar to tobacco products.

    Health Minister Terry Lake said Thursday the crackdown is intended to prevent young people from being exposed to e-cigarettes, which are increasing in popularity but have unknown long-term health effects.

    “Because e-cigarettes are so unregulated we don’t know what’s in them, we don’t know what the potential health effects are for young people particularly,” said Lake. “While adults can make their own choices, we think young people need to be protected from something that the health effects of which are largely unknown.”

    The move, outlined in legislation Thursday, essentially bans the use of e-cigarettes in the same way traditional cigarettes and cigars are already prohibited – though people can choose to continue to smoke inside their condos or homes, depending on strata rules.

    Using an e-cigarette, called vaping, will be forbidden inside all public buildings, including bars, restaurants, coffee shops, recreation centres, workplaces, hospitals, schools, movie theatres and most other spaces where traditional smoking is banned.

    The ban extends to all public and private school grounds. Health authorities can still set aside special e-smoking areas, such as those currently used for cigarettes.

    E-cigarette usage in parks will depend on bylaws passed by local municipalities.

    Businesses that sell e-cigarettes will also have to use block the display of the products, and any advertising toward youth is forbidden, said Lake.

    The new rules should come into effect before the end of the year, said Lake.

    They’ll include fines ranging from $58 to $575 for people who use e-cigarettes in banned places, as well as fines of $575 for the sale to minors. Businesses that sell e-cigarettes improperly could also face administrative sanctions up to $5,000, according to the Ministry of Health.

    E-cigarettes are battery-operated devices that usually contain nicotine-infused liquid, which is combined with vapour when the user inhales. Some vapour is flavoured.

    There’s little known about the long-term health effects of the vapour, said Lake, though e-cigarettes could have a legitimate use to reduce addiction and cut tobacco usage.

    However, Lake said he believes more young people are using the devices and so the government is compelled to act to prevent access to what could be a gateway product into smoking regular cigarettes.

    Advocates for electronic cigarettes have argued that they are effective smoking cessation devices for people who have unsuccessfully tried conventional treatments such as gum, patches and medication, and that they are a less dangerous alternative to smoking. The few peer-reviewed studies that have been conducted suggest they are about as effective as the patch.

    Other provinces, such as Ontario and Nova Scotia, have already moved to restrict sales to minors.

    The City of Vancouver banned e-cigarettes in public spaces and the sale to minors last fall. The Vancouver School Board also forbids the devices on school property.

    NDP health critic Judy Darcy praised the e-cigarette move, but said the government should have expanded its legislation to ban all flavoured tobacco products.

    Lake said he’s confident federal health minsiter Rona Ambrose is moving to develop nationwide regulations on flavoured cigarettes and other products.

    Manitoba, Alberta and Ontario are considering or moving towards bans of flavoured tobacco.
