Quebec on Track to Ban Flavoured Vapes Starting Oct. 31
Canadians on edge about Quebec flavoured e-liquids ban.
Health Minister Christian Dube announced that on October 31 2023, Quebec plans on banning the sale of all flavoured e-liquids and vaping products.
Only tobacco flavoured and unflavoured e-liquid products will be allowed to be sold.
This ban aims to deter folks from vaping, especially the younger crowd. The goal is to make vaping seem less attractive by providing less options for flavours and products.
Vaping Industry Feedback
The vaping industry and vape users are outraged. Angelina Raimondo, who runs 14 vape stores across Quebec, spoke out to express her upset towards the ban.
“90% of my e-liquid business is flavoured”, she says. “This right here. That’s it out of the entire store”, she says, pointing to a small shelf in one of her shops.
Quebec business owners across the province are wondering how they’ll survive with this ban ensuing soon, due to the rapid drop in sales they will have.
Meanwhile, Flory Doucas of the Quebec Coalition for Tobacco Control, is thrilled. “This is really what was needed to reduce the appeal of vaping products among our youth”.
Doucas agrees that this change was necessary in order to reduce vape consumption, but Raimondo argues that vaping has helped for many to quit smoking and that this ban is counterproductive.
She wonders if herself, among others, might end up returning to cigarettes after the flavour ban is put through. Quebec flavoured e-liquids ban removes a popular option for harm reduction from cigarettes.
Black Market Concerns
There is also concern of illegal black market vaping products rising, as mentioned by Eric Gagnon, Imperial Tobacco Canada’s vice-president of legal and external affairs. “[Young people] will inevitably continue to obtain their supplies the same way adults will from now on – through the black market, where products are unlicensed and there are no safety standards.”
Although discourse from either side of the spectrum ensues, pro-vapers are considering taking legal action on the province of Quebec in regards to the flavour ban.
For vapers, purchasing flavoured nicotine products is still possible.

Health Canada will soon be releasing a Canada Gazette to propose a federal flavour ban
While initially we believed this would be released around November 2021, we now have credible information indicating that we may see the release of the Gazette, Part 1, as early as May. The only reason this hasn’t been published in the Gazette yet is that they are still thinking about a total ban vs tobacco and mint flavours only. Gazette 1 is expected in May, and they expect Gazette 2 around September. This is evident as the Ontario Tobacco Research Unit’s webinar shows us the government’s intention and their playbook to ban flavours.

The Situation: According to the Gazette 1, a flavour ban may finalize as early as 60 days from now. If this happens, adult vapers will no longer have flavour options and vape shops will lose significant business and close. Resulting in a severe impact to the vaping industry.
The Solution: A consumer campaign has been launched to petition against the flavour ban. The goal is to achieve 250,000 consumer letters within 60 days. To achieve this we are aiming at minimum 10 submissions a day between now and the end of May. We need your support; don’t regret not having taken action when you had a chance.

Canadian Vaping Association suggests banning flavours is not the right option for Canada.
Samuel Tam, the president of the Canadian Vaping Association had an interview with CBC News: Compass last Thursday. In his conversation, he shared his concern regarding the proposed bill in Prince Edward Island that would severely restrict the flavours of e-liquid available for vapers in that province. Tam stated: “There are other ways to regulate and restrict youth from being able to access vaping products while still maintaining the options for adult smokers to wean off cigarettes and onto much safer vaping products.”
Tam said “If we look at the B.C.government, what they’ve done is they’ve restricted flavors to adult only specialty stores and they limit nicotine concentration level.”

Tam goes on to say: “Advertising promotions also need to be restricted, especially in places where kids have access to, which is really important. Ontario took that approach by banning advertising and promotions in convenience stores and gas stations were we know a lot of Canadian youths are congregating to buy their gums and candies.”
The concern with many people involved in the vaping industry is that restricting flavours will turn many current vapers back to cigarettes. The a CSA (Atlantic Convenience Stores Association) and CICC (Convenience Industry Council of Canada) both suggested that the bill proposed in Prince Edward Island would push former smokers back to cigarettes.
Tam also challenged the regulations within the Tobacco and Vaping Products Act in regard to “naming conventions”. This would restrict companies from using language to describe the flavour of the E-liquids such as cotton candy, fruity pebbles, etc. “It’s hard for them (adult customers) to identify the flavours if the flavuor is called number 18, right? So one of the key things is adults will be able to know the flavour when they walk into an adult only vape shop.” Tam stated.
The Canadian Vaping Association meets with Health Canada regularly and has proposed some ideas around limiting vaping ads. Some of them included a two-step age verification process which would make it more difficult for youth to gain access to any vaping products.
The critical piece of this discussion ultimately comes down to the free choice of adults to purchase products which have been proven to be 95% safer than smoking in an effort to quit smoking, contrasted with the current epidemic of youth vaping in Canada. This is not an easy problem with an easy solution, and will likely require all of the leaders to come together within the industry as well as within our government to adapt a series of regulations that will both protect the youth, and continue to provide the choice for adult smokers looking to transition away from tobacco cigarettes.
