    Canadians on edge about Quebec flavoured e-liquids ban.

    Health Minister Christian Dube announced that on October 31 2023, Quebec plans on banning the sale of all flavoured e-liquids and vaping products.

    Only tobacco flavoured and unflavoured e-liquid products will be allowed to be sold.

    This ban aims to deter folks from vaping, especially the younger crowd. The goal is to make vaping seem less attractive by providing less options for flavours and products.

    Vaping Industry Feedback

    The vaping industry and vape users are outraged. Angelina Raimondo, who runs 14 vape stores across Quebec, spoke out to express her upset towards the ban.

    “90% of my e-liquid business is flavoured”, she says. “This right here. That’s it out of the entire store”, she says, pointing to a small shelf in one of her shops.

    Quebec business owners across the province are wondering how they’ll survive with this ban ensuing soon, due to the rapid drop in sales they will have.

    Meanwhile, Flory Doucas of the Quebec Coalition for Tobacco Control, is thrilled. “This is really what was needed to reduce the appeal of vaping products among our youth”.

    Doucas agrees that this change was necessary in order to reduce vape consumption, but Raimondo argues that vaping has helped for many to quit smoking and that this ban is counterproductive.

    She wonders if herself, among others, might end up returning to cigarettes after the flavour ban is put through. Quebec flavoured e-liquids ban removes a popular option for harm reduction from cigarettes.

    Black Market Concerns

    There is also concern of illegal black market vaping products rising, as mentioned by Eric Gagnon, Imperial Tobacco Canada’s vice-president of legal and external affairs. “[Young people] will inevitably continue to obtain their supplies the same way adults will from now on – through the black market, where products are unlicensed and there are no safety standards.”

    Although discourse from either side of the spectrum ensues, pro-vapers are considering taking legal action on the province of Quebec in regards to the flavour ban.

    For vapers, purchasing flavoured nicotine products is still possible.

    As expected, a constitutional challenge has just been filed today. The lawyers of the Canadian Vaping Association (CVA) characterize the new provisions under the Provincial Bill 44 as a “legislative overkill” and will ask the Provincial Government to justify its position against vaping.

    The Canadian Vaping Association is stepping up to challenge what are, by far the most radically aggressive regulations in Canada against vaping.  The Quebec government has virtually eliminated vaping retail locations, and all online sales inside of Quebec, making it nearly impossible for smokers to find e-cigarettes in Quebec.  This is far beyond what other provinces have proposed as an initial response to vaping, and is very close to breaking the constitutional rights of vapers and smokers looking to vape in Quebec.  It is very good that the CVA has stepped in to challenge this regulation, although only time will tell the effectiveness of this challenge. In the meantime, we are happy to see someone supporting the vaping community in Quebec and stepping in to defend the basic rights of any smokers who may want to choose an alternative to cigarettes.

    cigarette industry, has filed a legal challenge against Quebec’s Bill 44, An Act to Bolster
    Tobacco Control, which took effect on November 26, 2015.
    “By prohibiting the testing of e-cigarettes in specialty vape shops, banning display and
    promotion in store and online sales of any vape product, we believe the Government
    of Quebec should be taken to task over the constitutionality of Bill 44”, said Mr. Beju
    Lakhani, President of the Canadian Vaping Association. “Our membership includes
    those who wish to vape rather than smoke tobacco and those who assist customers
    choose the most appropriate products that are right for them and, of course to help
    them understand how to use them properly. By introducing these measures, the
    Government of Quebec, we believe has overstepped its legislative authority, which
    leaves us with no other choice than to bring this matter before the courts,” said Mr.
    Lakhani.

    The CVA, as an active stakeholder in the vaping industry participated in the public
    consultations and provided reasonable alternatives to the measures proposed in Bill
    44.

    When describing how members feel about the action, Mr. Lakhani added, “legal action
    is not something we ever contemplated undertaking, nor is it something we take lightly, however, we have been left with no other alternative.”

    The CVA believes that by imposing these measures, the government may be faced with
    the unintended consequence of driving the vaping market underground where
    regulation, including the ban on sales to minors, will be next to impossible. Under Bill
    44, Quebec consumers are still able to buy products online from sites domiciled in
    other Canadian provinces or even off-shore – this at a time when the government is
    trying to restrict on-line sales of gaming sites in the province. “It makes no sense to
    create a negative situation for smokers who want to quit smoking in favour of a safer
    alternative in vaping ”, said Mr. Lakhani

    New users of vaping technology and products who cannot obtain the products and
    technology from qualified specialty vape stores under this current regulatory
    environment will not be able to get “in person” access to adequate and appropriate
    information or instruction on how to use the product effectively.

    “Vape shop owners used to spend on average about an hour to an hour and a half
    detailing customers who are motivated to get off tobacco, specifically those who are
    new to the technology. We are no longer allowed to provide this hands on instruction in
    Quebec due to Bill 44 and I fear the motivation is simply politics,” said Mr. Lakhani.
    Formed in 2014, the CVA has membership across Canada. Its core mandate is to work

    millions of Canadians want to stop smoking in favour of a safe alternative to tobacco.

    The CVA has met with legislators in provinces across Canada and with Health Canada
    on this issue. Further, the Association believes that Regulation is necessary and must
    ensure the safety of all Canadians responsibly and without infringing on their
    constitutional rights for access to alternatives to smoking.

    The Quebec government has stepped way out of bounds, fully classifying and restricting vaping and e-cigarette use to parallel their smoking regulations.  In no uncertain terms, this regulation will cause more people in Quebec to die from smoking related illnesses.  Their extreme actions make vaping seem, to those who are not informed, to be as high risk to health as smoking cigarettes.

    The Quebec government is attempting to ‘protect’ the citizens of Quebec from something that could save tens of thousands of lives in Quebec, providing them with a much safer alternative to smoking cigarettes.  This is a travesty, and my hope is that the vaping community will rally up and fight against this bill. The further implications of this bill could soon reach other provinces, as several have taken a ‘wait and see’ approach.

    Anti-smoking groups hailed Quebec’s new tobacco-control law Friday as a world precedent.

    “We’re thrilled,” said Flory Doucas, co-director of the Quebec Coalition for Tobacco Control.

    “The minister (for Rehabilitation, Youth Protection and Public Health, Lucie) Charlebois delivered,” Doucas said.

    Bill 44, first introduced in May, places limits on electronic cigarettes and smoking in public places, including outdoor café terrasses. It received unanimous support in the National Assembly.

    Under the law, smoking on the outdoor terrasses of Montreal bars and restaurants will be prohibited — despite bar owners protesting this will cut down on business.

    Doucas said the bill sets a world precedent in setting a minimum size for cigarette packages, thus preventing manufacturers from producing small, slim packs resembling a lipstick or iPod.

    The smaller packs allowed manufacturers to shrink the size of health warnings which must cover 75 per cent of the front and back of cigarette packs under federal law, Doucas said.

    “Packaging was becoming smaller and smaller,” she said.

    Doucas also praised the government for banning flavoured cigarettes like menthol or cherry-flavoured smokes, which are popular with young smokers.

    The law also means that smoking e-cigarettes, commonly known as vaping, will be banned in the same locations as traditional cigarettes, and the selling of flavoured cartridges is forbidden. The sale to minors is also prohibited.

    Doucas said the government took a balanced approach to e-cigarettes, which some studies suggest could be helpful in aiding smokers kick the habit, while other experts warn they are a gateway to smoking among youth.

    “They’re still available but we don’t make them attractive to youth,” she said.

    The new legislation also makes it illegal to smoke in a vehicle when a child under 16 is present. It also bans smoking at exterior playgrounds and sports fields used by kids.

    Smoking is also prohibited on the grounds of all schools, as well as daycares, adult education centres and professional training centres.

    Advertising of tobacco products is also further restricted under the new law, and new sanctions are in place for those who sell tobacco products to minors or for adults who purchase tobacco for minors. The amount for fines has also been increased.

    “The law adopted (Thursday) contains ambitious measures that will allow Quebec to become a world leader in the fight against tobacco,” Charlebois said in a statement.

    The Canadian Cancer Society reacted favourably to the new legislation.

    “Smoking is the leading cause of preventable death in Quebec and is responsible for a third of cancers,” Suzanne Dubois, executive director of the CCS in Quebec, said in a statement. “Anti-tobacco legislation is a primary tool in the fight against cancer. No other prevention measure can save as many lives. With (Bill 44), the Couillard government is striking hard.”
