    Proposed bill in Saskatchewan will increase restrictions on vaping

    Jim Reiter, the Health Minister of Saskatchewan has introduced a bill proposing changes to the Tobacco Control Act.

    The legal age for smoking in Saskatchewan will remain at 18; however, the majority of current tobacco regulations and laws will now be emulated to vaping products. The proposed restrictions will mirror those currently in place for tobacco in advertising and displays.

    Reiter states “If you walk into a convenience store, the vaping products are going to have to be behind the screen. They can’t have advertising when you walk in.  the same restrictions as tobacco on where you can vape,  it’s the same as we can smoke. I would say, very broadly speaking, what you’re seeing is it being treated exactly like tobacco”.

    This is a great supporting argument to limit the sale of vaping products to regulated vape stores.  This way, patrons will be required to show government identification on entering the location as opposed to gas stations and convenience stores, where anyone can enter. Unfortunately, it looks like this is not the way the Saskatchewan government will regulate vaping products.

    Reiter noted that this is a complex issue because smokers use vaping products as a smoking cessation tool.

    If this Proposed bill in Saskatchewan is passed, the first stages of this bill would ban displays of any vaping and e-cigarette products in any areas that young people have access to such as convenience stores, gas stations, etc. The bill would also ban sales of vaping products at amusement parks, arcades, and theatres. The ban would also include prohibiting vaping in and around public buildings such as schools.

    From our perspective, regulating vaping products is a much better plan than outright banning them. E-cigarettes have their place and are saving lives across Canada. By adding restrictions that should reduce the youth’s access to vapes in Saskatchewan, we believe this to be a good overall step.

    Saskatchewan’s Health Minister Cautious About Vaping Ban

    The government of Saskatchewan is considering a province-wide ban on vaping in public places. However, it appears that such a ban may not be enacted anytime soon, if at all.

    SUMA Convention and the Vaping Resolution

    A resolution regarding the use of e-cigarettes was passed at the Saskatchewan Urban Municipalities Association (SUMA) convention. During a session known as the ‘bear pit’, cabinet ministers fielded questions from municipal delegates from across the province.

    The Question of a Vaping Ban

    Regina city councilor Bob Hawkins asked Health Minister Dustin Duncan whether the province would support a ban on vaping. Duncan responded, “The intent is to ensure that we don’t have a patchwork. I’m not sure how that’s really possible.” He further explained that even if a law was created and added into current tobacco legislation, inconsistencies surrounding the rules on vaping could remain as cities and towns still have the option of going above and beyond such a law.

    The Role of Municipalities

    Duncan emphasized that municipalities are independent and can make their own decisions if they feel the need to implement stronger measures than those proposed by the provincial government. Some municipalities, like Saskatoon, already have their own vaping bylaws in place, while others, like Regina, do not.

    The Potential Benefits of Vaping

    Duncan also expressed caution, noting that e-cigarettes seem to help people quit smoking regular cigarettes, which aligns with the government’s ultimate goal of reducing tobacco use. He stated, “It is anecdotal at this point, but certainly people have found success in reducing their reliance on tobacco because of vaping.”

    Government’s Stance on Vaping

    The minister said the government would take SUMA’s wishes on vaping under advisement while decisions are made regarding the issue. This cautious approach reflects a desire to gather more data and information before making any definitive decisions on a province-wide ban on vaping.

    Of all of the Provinces and municipalities looking into potential bans and/or restrictions in Canada, I think Saskatchewan is doing it with the most thought.  They are not ‘jumping on board’ withe the fear mongering of other provinces, but are actively asking questions and determining whether an outright ban is even the best idea.

    I think many of the people in the government of Saskatchewan realize how devastating an all encompassing ban could be on a potentially very positive and life saving device for smokers.  They don’t want to jump the gun and are taking their time with the decision.

    Delegates representing cities and towns across the province are voting in favour of getting the provincial government to issue a ban on vaping and smoking in public places.

    The resolution narrowly passed in a close vote Tuesday at the Saskatchewan Urban Municipalities Association (SUMA) convention.

    Regina Mayor Michael Fougere voted in support of the province-wide ban, which can be looked at as if you can’t smoke there, you can’t vape there.

    “We don’t know whether it’s safe or not … until we know that it’s a health issue,” he said.

    Fougere has deferred to the province in the past to take the lead on this issue, even though Saskatoon has already passed a bylaw to this extent. He argued smoking is a health issue, which falls under provincial legislation, believing it would be easier for the government to enact change so that there isn’t a patch work of different rules in different areas of Saskatchewan.

    Weyburn Mayor and SUMA president Debra Button said they just wanted some consistency for travellers, whether it’s all supporting a ban or all against a ban.

    “We’re saying it should be one way or another, but it should be the same,” she said, but added with the voting split maybe that message wasn’t exactly received.

    The resolution is something Bakken Vapes Owner Chris Lefonte hoped would be defeated. Obviously, he doesn’t agree with putting new rules surrounding vaping in with smoking legislation.

    “The problem with that is it’s much harder to come back. Once you’ve lumped it in with cigarettes, it’s there forever and realistically to repeal something, or a piece of legislation that’s been put in; it’s going to be extremely difficult to do,” Lefonte explained.

    He said since there’s no scientific evidence that vaping and second-hand vapour is detrimental to health, like there is with cigarette smoke, it’s really all about perceived harm than actual harm.

    “The toxins are barely measurable that are there and much more comparable to air than second-hand cigarette smoke. To make it illegal to vape outdoors, especially in public places, just doesn’t seem right.”

    Nonetheless, the supported resolution will now be forwarded to the government of Saskatchewan.
